New federal government rules just announced may cause many colleges from access to student aid money as part of a so-called crackdown against schools who are leaving their students high and dry with too much debt and doing nothing to improve their job prospects. The new rules include regulations that for-profit schools have to meet to get access to federal financial aid money. If graduates owe too much of a percentage of their income or too few graduates of a given school are paying back their loans on time, then that school could lose access to Pell grant money and other federal student aid. The result of this is that schools effected will have a more difficult time attracting students. This could be a major hit for a school because it is said that as much as 90 percent of a school’s revenue can come from government aid. According to the new rules, schools will be able to receive federal financial aid if at least 35 percent of its former students are paying back their loan. Moreover, the estimated annual loan payment of a typical graduate must not be larger than 30 percent of the graduate’s discretionary income calculated to be 12 percent of his or her total earnings.

Many believe that such rules will make it more difficult for minorities and students from low income families access to funding options and thus limiting the schools that they may be able to afford to attend.

A Myth Regarding Personal Injury Protection

I often get told by my clients that they “do not want to make any claims on their own insurance policy” because “it will raise their rates.” Like many things, this is an insurance tactic meant to scare people from claiming what is rightfully theirs. Let me elaborate further.

Under Texas law, every person in the State must carry Personal Injury Protection (“PIP”) coverage on their auto insurance policy, unless you expressly sign a rejection or “opt-out” of this coverage. The State minimum requirement is $2,500, although many people carry $5,000 or $10,000 in coverage (or sometimes even more, depending on what their auto insurance carrier offers). Importantly, under the Texas Insurance Code, it is illegal for your insurance company to raise your insurance rates, drop your coverage, affect your credit, etc. for making these claims. Therefore, if you have this coverage, you always want to use it.

PIP coverage is meant to reimburse you for two things: (1) medical bills you have already incurred or (2) lost wages (although it will only cover 80% of your lost wages). Additionally, Texas allows “stacking” of insurance benefits. For example, let’s say you get into an accident and you are taken to the emergency room where you incur a $10,000.00 bill. Let’s also say that you have the standard $2,500 PIP policy through your insurance company. After you are finished treating, we send that same $10,000 bill to both the Defendant’s insurance company and to your own. We get you paid $10,000 from this insurance company plus $2,500 from your own PIP coverage for a total reimbursement of $12,500. That’s right, you get paid $12,500 for a bill that was originally $10,000.

I always tell my clients the same thing: If you pay for this coverage every month in your premium, and if your insurance company cannot raise your rates for using it, then why wouldn’t you use it? It is free money falling out of the sky. However, because it’s free money falling out of the sky, many insurance companies (and their agents) will deliberately try to convince you that you do not need it because “it cost more.” Again, this cannot be further from the truth. The cost of this coverage is literally pennies on the dollar for what you get in return should you need to use it. Further, the best part is that this coverage is no-fault, meaning you are entitled to these benefits whether you caused the accident or if someone else hit you.

For these reasons, it is a no-brainer not only to have this coverage, but also to use it once you need it.

How Do Strong Social and Community Ties Impact Your Health?

I called my friend, also named Lisa, who lives in Houston, Texas. Hurricane Harvey’s devastation had not only hit Houston, the fourth largest city in the United States, but many communities in the Gulf Coast region. According to my friend, who lives on the north side of Houston where they got no flooding except for those who were near a river or large body of water, the worst of the rain is over. People are leaving shelters scattered thought-out Harris County, where Houston is located.

Out of the 6.5 million people in the greater Houston area only about 1.5 million lost power and most all the water is drinkable. No need for ice, a valuable commodity, for many of us here in Charleston who experienced the wrath of Hurricane Hugo. Unlike Houston, Hurricane Hugo, also a category 4 storm, was a direct hit and as a result we not only got the flooding but also high winds. But no one can deny that the Houston area experienced the worst flooding in its history, with some areas getting as much as 50 inches of rain. And because Hurricane Harvey’s devastation was so widespread, it will take years for the region to recover from this natural disaster.

My friend, Lisa, who is originally from Charleston, knows about hurricanes and the emotional roller coaster they bring; the anxiety before the storm of not knowing exactly what is going to happen, the storm itself, the flooding and aftermath once the storm has passed. No doubt, you too, no matter where you call home, are aware of the horrific situation the residents of the Gulf Coast region, north of Brownsville, Texas, are now experiencing. Lives have been lost, people displaced and the uncertainty of what’s ahead. It is one thing to watch the news again and again and be reminded of the destruction and the anguish.
